Terms of Service

Please read these Terms of Service ("Terms") carefully before using Presaga ("the Service"), operated by Presaga ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The service

Presaga is a decision-intelligence platform powered by the PRISM simulation engine. It produces structured simulations of how audiences and stakeholders may react to a statement, campaign, or decision — not predictions or polls.

Important: Presaga's simulation outputs are generated by artificial intelligence and should be treated as one strategic input among many. We do not guarantee the accuracy, completeness, or predictive reliability of any simulation report. Real-world outcomes depend on factors beyond any simulation's scope.

2. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately if you suspect unauthorized access.

You must be at least 18 years of age to use the Service.

3. Acceptable use

You agree not to:

  • Submit content that is unlawful, defamatory, obscene, or that infringes any third party's rights
  • Use the Service to generate content intended to deceive, defraud, or manipulate the public
  • Attempt to reverse-engineer, disassemble, or extract the source code of the Service
  • Interfere with or disrupt the Service's infrastructure
  • Exceed your plan's usage limits through automated means
  • Resell access to the Service without a written partnership agreement
  • Use the Service for any purpose that violates applicable law

We reserve the right to suspend or terminate accounts that violate these terms.

4. Your content

You retain ownership of all documents and content you submit to the Service ("Your Content"). By submitting content, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of generating simulation reports.

We do not use Your Content to train AI models. Your Content is processed for your simulation and then retained only as long as necessary to deliver the report and maintain your account history.

You represent that you have the right to submit Your Content and that it does not infringe any third party's intellectual property rights.

Links and material you supply. You are responsible for having the right to point the Service at the pages and conversations you submit. The Service reads pages you link to as an ordinary visitor would — never logging in, never reading behind a paywall — records when it read them, and may send short research terms (a place and a role — never your content) to a third-party web-search provider to identify real public bodies relevant to your briefing. The Service does not log in to, scrape behind authentication, or bulk-collect any site.

5. Simulation reports

Reports generated by the Service ("Reports") are provided to you for your use. You may share, distribute, or publish Reports at your discretion.

Reports are generated by AI and contain simulated interactions from fictional AI-generated personas. Reports do not represent the views or opinions of any real person or organization. Any resemblance between AI-generated personas and real individuals is coincidental.

6. Pricing and payment

Presaga offers both one-time simulation purchases and subscription plans. Current pricing is displayed on our website and may change with 30 days' notice to existing subscribers.

Payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service.

Subscription plans renew automatically. You may cancel at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.

Refunds are available within 7 days of purchase if a simulation fails to complete due to a technical error on our part. Refunds are not available for completed simulations.

7. Intellectual property

The Service, including its design, code, and documentation, is owned by Presaga and protected by intellectual property laws. The underlying simulation substrate (MiroFish) is open-source software licensed under AGPL-3.0.

Nothing in these Terms grants you rights to our trademarks, logos, or brand assets.

8. Limitation of liability

To the maximum extent permitted by law, Presaga and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from:

  • Your use of or inability to use the Service
  • Any decisions made or actions taken based on simulation reports
  • Unauthorized access to your account
  • Any third-party conduct on the Service

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that simulation results will be accurate, reliable, or predictive of real-world outcomes.

10. Privacy

Your use of the Service is also governed by our Privacy Policy.

11. Modifications

We may modify these Terms at any time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

12. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada.
